Transborder Divorce: Its Tax and Immigration ConsequencesInternational marriage is romantic. However, many such marriages do not last very long. The divorce or annulment of international marriage usually has unique difficulties because it entails legal analysis of different jurisdictions. International tax issues, international enforcement of divorce decrees, international custody issues, property division and enforcement of property related orders can impact one’s immigration status if one spouse is a United States citizen or lawful permanent resident. The alien spouse may lose immigration status as a result of divorce or annulment. However, there are multiple options for the alien spouses to get their permanent resident status even after divorce or annulment.
This seminar will analyze the unique issues inherent in divorces and in annulments of marriage with international attributes, its impact on tax and immigration status of the alien spouse, and the alien spouse’s options to remain in the United States legally.
