    Join four distinguished speakers for an engaging discussion of the recent landmark U.S. Supreme Court antitrust decision, American Needle, Inc. v. National Football League, and its emerging implications for the antitrust analysis of both joint ventures and joint intellectual property licensing programs, and for sports antitrust issues generally. The panelists, a law professor and three top private practitioners with vibrant antitrust and intellectual property litigation and transactional practices, will provide insightful commentary regarding anticipated and actual results from the application of American Needle to cooperative ventures, IP licensing enterprises, and branding efforts within the world of professional sports and beyond.

    In American Needle, the U.S. Supreme Court held that the NFL's licensing program for individual football teams' intellectual property conducted through the NFL's joint licensing entity, NFL Properties, constituted concerted action that was not categorically beyond the coverage of Section 1 of the Sherman Act. The Supreme Court reversed the Seventh Circuit's ruling that the NFL acts as a single entity in licensing intellectual property and thus is immune from scrutiny under Section 1. The Supreme Court held that because each of the NFL teams is a substantial, independently owned, and independently managed business, the NFL and its teams do not possess either the unitary decision making quality or the single aggregation of economic power characteristic of independent action.

    Nevertheless, the opinion leaves open a number of important issues such as when a "quick look" approach is warranted and the decision's application to other activities of professional sports teams. This significant decision not only affects professional sports leagues, but also potentially reaches a wide range of joint ventures involving potential competitors and associations that engage in cooperative activity but maintain individual identities within that framework.

    The topic of criminal case settlement can be a confusing and serpentine area of the law, particularly to newer criminal attorneys. Because of the vastness of the criminal court system in Los Angeles County, criminal cases are settled in various ways depending on the court. This seminar attempts to give members of the criminal bar some general guidelines regarding how to approach the settlement of a felony or misdemeanor case in the Los Angeles Superior Court. By bringing together all facets of the criminal justice system, this seminar will attempt to provide practical and anecdotal examples of what to expect in court when settlement is an option. Supervising Judge Peter Espinoza will provide the bench’s view of case settlement, both at early stages of the process and at trial. Defense attorneys George Bird and Richard Hutton, both recipients of LACBA’s Criminal Justice Section’s “Defense Attorney of the Year” award, will talk about various ideas regarding case settlement, including alternatives to incarceration and dealing with clients. Deputy District Attorney Danette Meyers, also an awardee of LACBA’s Criminal Justice Section’s “Prosecutor of the Year,” will give her perspective of managing an early-disposition court and suggestions to approaching case settlement.

    In light of last June’s very successful evening seminar, the Criminal Justice Section will again be offering this seminar as an evening event with light dinner. We want to have a session that has a great amount of discussion about the topic, as well as being highly informational and topical.

    This presentation will focus on substance abuse and mental illness in the legal profession, as well as conditions which may result in an attorney's reduced ability to function psychologically, socially, occupationally or interpersonally. In addition, coping strategies and treatment solutions will also be discussed.

    Dr. Alex Yufik is a Board Certified Forensic Psychologist and a licensed attorney. He obtained his law degree from Villanova University School of Law and his doctorate in clinical psychology from George Washington University in D.C. Dr. Yufik is employed by the State Bar of California as a Case Management Supervisor at the Lawyers Assistance Program, where he supervises other clinicians in the program and conducts evaluations of attorneys who require monitored recovery and treatment from substance abuse and/or mental illness. He also assists the State Bar Court and Office of Chief Trial Counsel regarding attorneys who face disciplinary proceedings and have mental health problems. In his private practice, Dr. Yufik sees patients, conducts forensic evaluations in criminal and civil cases such as, competency to stand trial, criminal responsibility, sex offender evaluations, Posttraumatic Stress Disorder and psychological injury.
