Machiavellian Scheduling – How to Recognize it, How to Handle it, How to Avoid it

Schedule delays are among the biggest risks to construction projects because time is money and project success depends upon timely completion. The project schedule is a powerful instrument which, when properly used, helps the project team navigate to a successful delivery. Unfortunately, today’s sophisticated computer scheduling programs also provide the power and flexibility to distort and manipulate true delay entitlement.

As attorneys, it is imperative for you to be able to cut-through the CPM gibberish and understand the basics of how and where schedules can be manipulated. Moreover, the inherent shortcomings of certain schedule analysis methodologies can be used to intentionally misrepresent impacts and delays when those methodologies are used in place of approaches that are acceptable according to industry standards and case law.

Please join us for this informative and unusual program, as our speakers ‘lift the curtain’ on the dark art of schedule manipulation and deception. This program will shed light on the techniques commonly used in costly delay-related change orders and claims. Handout materials include a selection of state and federal case law addressing delay claims and schedule-related litigation.

This session will be presented by Ken Baker from Hill International and Daniel Phelps, Esq. from Law Office of Daniel J. Phelps.
