What the POM Wonderful v. Coca-Cola Decision Does -- and Doesn’t -- Tell Us About the Future of False Advertising Claims Against Food and Beverage Companies

The recent Supreme Court decision in POM Wonderful v. Coca-Cola brought to the forefront several issues regarding false advertising claims against food and beverage companies. The decision answers some preemption questions regarding Lanham Act claims brought by competitors, but does not speak to many other key issues in this space relating to consumer class actions. This panel discussion will explore the implications of the POM Wonderful decision, as well as the questions it leaves unanswered with respect to labeling and advertising by food and beverage companies, and possible areas of risk and benefit with regard to products of other industries.
