The recent Supreme Court decision in POM Wonderful v. Coca-Cola brought to the forefront several issues regarding false advertising claims against food and beverage companies. The decision answers some preemption questions regarding Lanham Act claims brought by competitors, but does not speak to many other key issues in this space relating to consumer class actions.
