The Intersection of Insurance and Environmental LawInsurance intersects with environmental law in numerous ways. This presentation will focus on how that intersection plays out in the roles of a transactional environmental attorney, an insurance recovery litigator, and a broker of environmental insurance.
The program will begin with an overview of the risk transfer mechanisms and related insurance coverage issues confronting parties and their counsel in those roles and then move on to focus on a hypothetical case study where those individuals address specific issues arising from the acquisition of a commercial property impacted by environmental contamination. In that hypothetical case study, the specific issues discussed will range from dealing with existing and potential future cleanup cost claims, seeking recovery of cleanup costs under existing legacy comprehensive general liability (CGL) policies, and the acquisition and negotiation of pollution legal liability (PLL) insurance coverage to protect against contingent present and future liabilities.
