Program Information:
The LACBA Healthcare Law Section and the Los Angeles County Medical Association will present a program addressing hot topics of risk impacting physicians, related healthcare entities, and lawyers servicing them.
Prohibited Transactions: Attorneys Bruce Dizenfeld and Jeremy Miller will address risks involving transactions that may run afoul of healthcare fraud and abuse laws, such as anti-kickback and anti-referral laws and the laws prohibiting the corporate practice of medicine. Topics will include, among others, risks associated with ancillary services arrangements (e.g., clinical laboratory and diagnostic imaging), ambulatory surgery centers, and professional practice arrangements (e.g., part-time arrangements at another practice's location).
Employment Practices: Attorneys Beth Schroeder and Connie Michaels will address significant employment-related risks currently affecting physicians as employers/supervisors and as employees. Topics will include, among others, risks associated with discharging employees and how to minimize them, incorrectly classifying employees as exempt vs. non-exempt, incorrectly classifying personnel as independent contractors vs. employees, and employee leave matters.
Investigations and Audits: Attorneys Patric Hooper and Steve Goldsobel will address risks associated with investigations and audits. Topics will include, among others, risks associated with RAC audits, Medical Board investigations, how to respond when law enforcement arrives, and what to do when presented with a subpoena.
